These Terms and Conditions ("Terms") govern your use of our website located at yourlocalengineers.co.uk ("Website") and the boiler installation, repair and maintenance services ("Services") we provide.

By accessing our Website and/or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Website or use our Services.

2. SERVICES

2.1 Service Description
We provide boiler installation, repair, maintenance, and related services as described on our Website. The specific services to be provided will be agreed upon between you and us prior to commencement of work.

2.2 Service Booking
You may book our Services through our Website, by telephone, or email. All bookings are subject to confirmation by us and are based on our availability.

2.3 Service Cancellation
Our cancellation policy varies depending on the type of service booked:

- Call-Out Services: These require payment of a non-refundable call-out fee at the time of booking. Cancellations are non-refundable regardless of notice period.

- Standard Repair and Maintenance Services: Cancellations made more than 24 hours before the scheduled appointment will receive a full refund of any deposit paid. Cancellations made less than 24 hours before the scheduled appointment will incur a cancellation fee.

- Installation Services: Cancellations made more than 7 days before the scheduled installation date will receive a refund of the deposit paid, less an administration fee. Shorter notice periods result in higher retention of deposits.

3. PAYMENTS

3.1 Pricing
All prices listed on our Website are inclusive of Value Added Tax (VAT) at the current rate unless otherwise stated. Prices are subject to change without notice.

3.2 Payment Methods
We accept payment via credit/debit cards, PayPal, Apple Pay, Google Pay, bank transfers through  secure online payment system provided by Wix or Square.

3.3 Invoicing
Upon completion of Services, we will provide you with an invoice detailing the Services performed and the amount due.

3.4 Payment Terms
Payment for Services is due immediately upon completion of work. Late payments may incur a late fee of 5% per month.

3.5 Deposits
For certain Services, we may require a deposit of 70% of the estimated total cost prior to commencement of work. Deposit requirements will be communicated to you at the time of booking.

4. WARRANTIES AND GUARANTEES

4.1 Workmanship Guarantee
We guarantee our workmanship for a period of 12 months from the date of service completion. This guarantee covers defects in workmanship only and does not cover issues arising from normal wear and tear, misuse, or further damage caused by you or third parties.

4.2 Parts Warranty
Parts and components installed by us carry the manufacturer's warranty. We will assist you in processing any warranty claims related to parts we have installed.

4.3 Consumer Rights
If you are contracting as a consumer, you have certain statutory rights. These Terms do not affect your statutory rights as a consumer. For more information about your statutory rights, contact your local Citizens Advice Bureau or Trading Standards Office.

4.3 Exclusions
Our warranties and guarantees do not cover:
- Damage caused by misuse, neglect, or improper maintenance
- Issues arising from work performed by unauthorised third parties
- Problems resulting from force majeure events
- Normal wear and tear

5. CUSTOMER RESPONSIBILITIES

5.1 Access and Facilities
You are responsible for providing reasonable access to your property and full access to the boiler system during scheduled appointment times. You must also provide adequate working space, electricity, and water as required for the performance of the Services.

5.2 Safety
You must inform us of any known hazards or safety concerns at your property prior to our arrival. You are responsible for the safety of any individuals and pets at your property during the performance of our Services.

5.3 Permissions
You confirm that you have all necessary permissions and authority to authorise the Services being performed. This includes any landlord permissions if you are not the property owner.

6. LIABILITY LIMITATIONS

6.1 Scope of Liability
Our liability is limited to direct damages caused solely by our negligence in performing the Services. Our maximum liability shall not exceed the amount paid by you for the Services or the amount covered by our professional indemnity insurance, whichever is greater.

6.2 Exclusion of Liability
Nothing in these Terms shall limit or exclude our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any breach of the terms implied by Section 2 of the Supply of Goods and Services Act 1982
- Any other liability that cannot be excluded or limited by English law

6.3 Limited Liability
Subject to clause 6.2, we are not liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profit, revenue, or data
- Business interruption
- Damages arising from third-party claims
- Pre-existing conditions not caused by us
- Damage resulting from your failure to follow our advice or recommendations

6.3 Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, or expenses arising from your breach of these Terms or your improper use of our Services.

7. INTELLECTUAL PROPERTY

7.1 Ownership
All content on our Website, including text, graphics, logos, images, videos and software, is the property of Belsize Construction Limited, trading as Your Local Engineer, or our content suppliers and is protected by applicable intellectual property laws.

7.2 Limited License

7.3 Restrictions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. The most current version will be posted on our Website with the effective date. 

If the changes are material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Website and Services after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorised to use our Services, and must cease using our Website.

11. GOVERNING LAW AND DISPUTE RESOLUTION

- If mediation fails, the dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

13. ENTIRE AGREEMENT

These Terms constitute the entire agreement between us regarding our Website and Services and supersede and replace any prior agreements we might have between us regarding the same.

Cancellation Policy

 

1. INTRODUCTION

This Cancellation Policy forms part of the Terms and Conditions of Your Local Engineers, trading name of Belsize Construction Limited ("Company", "we", "our", "us"). This policy outlines the terms under which you may cancel appointments for our various services and any applicable fees or charges that may result from such cancellations.

2. CALL-OUT SERVICES

2.1 Definition
Call-Out Services are defined as services requested with less than 24 hours' notice where the customer requires urgent assistance due to no heating, no hot water, water leaks, or other situations that pose immediate risk to property or safety.

2.2 Payment
Call-Out Services require payment of a non-refundable call-out fee at the time of booking. This fee covers our initial attendance and diagnosis, regardless of the outcome.

2.3 Cancellation by Customer
Due to the nature of call-outs and the immediate allocation of resources:
- Cancellations of Call-Out Services are non-refundable regardless of notice period
- The call-out fee will be retained in full if you cancel after booking
- If you wish to reschedule (rather than cancel) a call-out, we will attempt to accommodate this request but cannot guarantee availability

2.4 Cancellation by Us
If we need to cancel an Emergency Call-Out Service:
- We will provide as much notice as possible
- You will receive a full refund of any call-out fee paid
- Where possible, we will prioritize rebooking your appointment

3. STANDARD REPAIR AND MAINTENANCE SERVICES

3.1 Definition
Standard Repair and Maintenance Services are defined as non-emergency boiler repairs, annual servicing, system checks, and similar services that are scheduled with at least 24 hours' notice.

3.2 Cancellation by Customer
For Standard Repair and Maintenance Services:
- Cancellations made more than 24 hours before the scheduled appointment will receive a full refund of any deposit paid
- Cancellations made less than 24 hours before the scheduled appointment will incur a cancellation fee of £95 or 20% of the quoted service price, whichever is greater
- No-shows (failure to provide access or be present for a confirmed appointment without prior notice) will be charged the full cancellation fee

3.3 Rescheduling
- Appointments rescheduled more than 24 hours in advance will not incur any fee
- Appointments rescheduled less than 24 hours in advance will incur a rescheduling fee of £95

4. INSTALLATION SERVICES

4.1 Definition
Installation Services refer to boiler replacements, new boiler installations, system upgrades, and similar major works requiring significant planning, parts ordering, and resource allocation.

4.2 Deposits
Installation Services require a deposit of 70 % of the total quoted price at the time of booking. This deposit secures your installation date and covers the cost of ordering specific parts and materials.

4.3 Cancellation by Customer
For Installation Services:
- Cancellations made more than 7 days before the scheduled installation date will receive a refund of the deposit paid, less a £95 administration fee
- Cancellations made between 2-7 days before the scheduled installation date will result in 50% of the deposit being retained
- Cancellations made less than 48 hours before the scheduled installation date will result in the entire deposit being retained

4.4 Rescheduling
- Installation appointments rescheduled more than 7 days in advance will not incur any fee
- Installation appointments rescheduled less than 7 days in advance may incur a rescheduling fee of £95, depending on whether parts have been ordered and resources allocated

5. FORCE MAJEURE

5.1 Definition
Force Majeure events include but are not limited to severe weather conditions, natural disasters, pandemics, government restrictions, or other circumstances beyond our reasonable control.

5.2 Cancellation Due to Force Majeure
If either party needs to cancel or reschedule due to Force Majeure:
- No cancellation fees will apply
- Any deposits or payments will be either refunded in full or applied to a rescheduled appointment at the customer's discretion
- We will work with you to reschedule at the earliest mutually convenient time

6. YOUR CONSUMER RIGHTS

6.1 Cooling-Off Period
If you are a consumer and you booked our services remotely (online, by phone, or by email):
- You have a 14-day cooling-off period from the date of booking
- You may cancel the service without penalty during this period, provided the service has not yet been performed
- If you expressly requested that we begin the service during the cooling-off period, you may still cancel but must pay for the services provided up to the point of cancellation

6.2 Consumer Rights Act 2015
Nothing in this Cancellation Policy affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

7. REFUND PROCESS

7.1 Payment Method
Refunds will be made to the original payment method used for the booking.

7.2 Processing Time
Refunds will be processed within 20 working days of the cancellation being accepted.

8. CHANGES TO THIS POLICY

We reserve the right to update or modify this Cancellation Policy at any time. Any changes will be effective immediately upon posting on our website. We will provide notice of significant changes to this policy on our website.
